Terms of Service

These are the terms for using Rochester Art, a community project for discovering public art in Rochester, Minnesota. We have tried to write them the way a human would actually talk. If anything is unclear, email support@rochestermnart.org and ask.
The short version
- Rochester Art is free, and it is provided as-is with no warranty.
- Be respectful of the art, the artists, and other users.
- Only submit photos you actually took (or have permission to share).
- Don't use the app to do anything illegal or abusive.
- We can remove content or suspend accounts if these terms are broken.
- This is a personal community project, not a business, and it runs on best effort.
1. Agreement
By using the Rochester Art website (rochestermnart.org) or the Rochester Art iOS or Android apps ("the Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service.
2. What Rochester Art is
Rochester Art is a free community resource that helps people find and learn about public art installations in Rochester, Minnesota. It includes a searchable catalog of artworks, curated walking and biking tours, and tools for users to contribute photos of artwork.
Rochester Art is a personal project run by an individual developer. It is not affiliated with the City of Rochester, the Rochester Art Center, the Art4Trails program, or any other organization, unless explicitly stated.
3. Who can use it
You can browse Rochester Art without an account. If you want to create an account, submit photos, start tours, or report artworks, you must be at least 13 years old. If you are under 18, you should have a parent's permission to use the Service.
You are responsible for keeping your password secure. If you think someone else is using your account, email us and we will help lock it.
4. Account rules
- One account per person. Don't impersonate anyone.
- Use a real display name or a reasonable nickname. No slurs, no harassment targets, no confusingly official-looking handles.
- Keep your login info to yourself.
- If you created your account with Google Sign-In, you're also bound by Google's terms for that service.
5. Acceptable use
We want Rochester Art to feel like a friendly tour guide, not a corner of the internet that has to be moderated into the ground. Please don't:
- Submit content that is harassing, threatening, hateful, pornographic, or otherwise awful
- Submit photos you don't own or don't have permission to share
- Vandalize, damage, or interfere with any actual artwork
- Use the Service to break the law or encourage anyone else to
- Scrape, reverse-engineer, or overload the API beyond ordinary personal use
- Upload malware or try to exploit the Service's security
- Misrepresent the location of an artwork or submit fake reports
- Use automated tools to create accounts or flood submissions
If you break these rules, we may remove your content, suspend your account, or block you from the Service.
6. Photos and other content you submit
You keep ownership of any photo, comment, or report you submit to Rochester Art. You are not transferring your copyright to us.
By submitting content, you grant Rochester Art a worldwide, non-exclusive, royalty-free license to display, store, and distribute that content within the Rochester Art website and apps, solely for the purpose of running the Service. You can revoke this license by deleting the content or by asking us to remove it.
You promise that:
- You took the photo yourself, or you have permission from the person who did.
- Publishing it does not violate anyone else's rights.
- The photo does not include minors in a way that would be inappropriate.
All submitted photos are reviewed by an admin before they appear publicly. We may decline submissions for any reason, including image quality or relevance, without explanation.
7. Our content
The Rochester Art name, logo, and the code that powers the website and apps are ours. You can use the Service for personal, non-commercial purposes. Please don't copy large portions of the site or resell access to our data.
Artwork metadata (titles, descriptions, locations) is compiled from public sources, the artists themselves, and community contributions. Where we know the artist, we credit them. If you are an artist and want a change to how your work is described, please email us.
8. Third-party services and content
Rochester Art uses Apple MapKit (on iPhone), Google Maps (on Android), and Google Sign-In. When you use those features, you're also interacting with those services, and their terms apply. We are not responsible for the content or behavior of third-party services.
9. Copyright concerns
If you believe something on Rochester Art infringes your copyright, email support@rochestermnart.org with a description of the work, where it appears on the site, your contact information, and a statement that you are the rights holder (or authorized to act on their behalf). We will review and remove infringing content promptly.
10. Disclaimer and "as-is"
Rochester Art is provided as-is, without any warranty of any kind, express or implied. We do our best to keep the information accurate and the service running, but we cannot promise that:
- Every artwork listing is fully up to date
- Every artwork shown is still physically at its listed location
- The Service will be available at any given time
- Directions and map routes are safe, legal, or free of hazards
Please use common sense when walking or biking to see art. Watch for traffic, respect private property, and follow posted signs. The app is a guide, not a safety device.
11. Limitation of liability
To the maximum extent allowed by law, Rochester Art and its operator are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. This includes things like lost time, lost data, or injury while following a walking or biking route from the app.
Nothing in these terms limits liability for death, personal injury caused by negligence, fraud, or anything else that can't be excluded under applicable law. If you are an EU consumer, you retain any mandatory consumer-protection rights that apply to you.
12. Suspension and termination
You can stop using Rochester Art at any time. To delete your account and associated data, email support@rochestermnart.org.
We may suspend or terminate your account if you violate these terms, abuse the Service, or put the Service or other users at risk. We may also shut down or significantly change the Service itself at any time, since this is a personal project maintained on a best-effort basis.
13. Changes to these terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top. For material changes, we will try to give reasonable notice (by email or in the app) before the new terms take effect. Continuing to use Rochester Art after the change means you accept the updated terms.
14. Governing law
These Terms are governed by the laws of the State of Minnesota, USA, without regard to conflict-of-law rules. Any dispute that can't be worked out directly will be handled by the state or federal courts located in Olmsted County, Minnesota, except where you have a non-waivable right to use a local court as a consumer.
15. App Store and Play Store terms
If you downloaded Rochester Art from the Apple App Store:
- These Terms are between you and Rochester Art, not between you and Apple. Apple is not responsible for the app or any of its content.
- Apple has no obligation to provide support for the app.
- In the unlikely event the app does not conform to any warranty, you can notify Apple and Apple will refund the purchase price (if any); beyond that, Apple has no warranty obligation.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded Rochester Art from Google Play, your use is also subject to the Google Play Terms of Service.
